Terms of Service

These Terms of Service ("Terms") govern your access to and use of Postmyn (the "Service"), operated by Postmyn ("Postmyn", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized access. We are not liable for any loss resulting from your failure to keep your credentials secure.

3. Your Content

You retain ownership of the landing pages, email content, subscriber lists, and other material you create or upload to the Service ("Your Content"). You grant Postmyn a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display Your Content solely to operate and improve the Service for you.

You are solely responsible for Your Content and for ensuring you have all rights and permissions necessary to use it on the Service.

4. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk email (spam) or violate anti-spam laws such as CAN-SPAM, CASL, or GDPR.
  • Send emails to purchased, rented, scraped, or otherwise non-consented lists.
  • Distribute malware, phishing content, or material that infringes intellectual property rights.
  • Harass, threaten, or deceive any person.
  • Attempt to reverse engineer, interfere with, or gain unauthorized access to the Service or its infrastructure.
  • Use the Service for illegal activity or in violation of applicable law.

We reserve the right to investigate suspected violations and to suspend or terminate accounts that we reasonably believe are in breach of these Terms.

5. Subscriber Consent

You are responsible for obtaining all required consents from your subscribers before sending email through the Service. Postmyn automatically includes a one-click unsubscribe link in all marketing emails sent through the Service. You must not suppress, remove, or obscure this link. When a subscriber unsubscribes, Postmyn suppresses that email address from future marketing sends through the Service. Postmyn also automatically suppresses email addresses that hard bounce or generate spam complaints.

6. Subscriptions and Payment

Paid plans are billed in advance on a monthly or annual basis and are non-refundable except as required by law. You authorize us to charge your payment method for all fees due. If payment fails, we may suspend or downgrade your account after reasonable notice.

We may change pricing for future billing periods with at least 30 days' notice. Your continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

7. Trials And Paid Plans

Postmyn is offered as a paid subscription with a 14-day trial for new accounts. We may modify pricing, subscriber bands, included fair-use email volume, and plan features for future billing periods with notice as described above.

8. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay amounts owed, or if continued provision of the Service becomes impractical.

Upon termination, your right to use the Service ends immediately. We will make your data available for export for a reasonable period after termination before deletion.

9. Intellectual Property

The Service, including its design, code, trademarks, and content we provide, is owned by Postmyn and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other branding.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the fullest extent permitted by law, Postmyn will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service is limited to the amount you paid Postmyn in the 12 months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify and hold harmless Postmyn and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising out of your use of the Service, Your Content, or your violation of these Terms or any law.

13. Changes to the Service and Terms

We may modify or discontinue features of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will notify you through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
